As behavioural economics reveals, human decision-making deviates from neoclassical assumptions about human behaviour and people (often) fail to make the ‘right’ welfare-enhancing choice. The purpose of Sunstein and Thaler’s concept of ‘nudge’ is to improve individual welfare. To provide normative justification, they argue that the only relevant normative criterion is whether the individual is ‘better off as judged by themselves’, so that the direction in which people are to be nudged is defined by their own preferences. In light of behavioural (...) findings, however, people’s choices do not provide a sound basis for eliciting preferences and thus for assessing welfare. In this paper, I aim to challenge Sunstein and Thaler’s normative view, arguing that it is unreasonable to rely on conventional welfare economics, particularly considering the given context. Sunstein and Thaler depend on an approach of ‘preference purification’ which assumes informed, latent, and true preferences: As a result they face crucial methodological, epistemological, and practical objections, and cannot show how their approach enhances individual welfare. By building on the concepts of R. Sugden and C. Schubert, I develop an alternative normative framework for behavioural public policy, based on a contractualist perspective in which people may consent to collective choice rules in order to align future behaviour with values, to achieve particular goals or to preserve personal integrity. Individual consent and citizens’ participation and deliberation are crucial to this approach. This contractualist approach may provide a normative justification for behavioural public policy, and help to reconcile behavioural and normative economics. (shrink)

New technologies not only contribute greatly to society and the economy; they also involve fundamental societal shifts, challenging our values and ideas about ourselves and the world. With a view to aligning technological change and innovation with ethical values, the concept of responsible innovation advocates the inclusion of a variety of stakeholders, in particular from society. In shifting moral responsibility towards the producers of innovations, responsible innovation rejects the standard normative economic view that the ethical evaluation of innovations is a (...) matter of individual consumers’ market-based choices. However, in this article we argue that responsible innovation should not abandon all normative consideration of the individual outright, to which end we present an alternative normative economic approach based on preference learning. We show how this approach can provide an enhanced understanding of responsible innovation by clarifying the redistribution of moral responsibility and casting individuals in the normative role of co-innovators, rather than mere consumers. We argue that responsible innovation should enable individuals to form preferences and evaluate innovations, so as to align innovation with ethical demands. Finally, we show how our proposed approach can be put into practice in so-called laboratories in real-world contexts, using methods from the field of design. In short, drawing on normative economics, this article aims to establish a new understanding of responsible innovation that is conceptually sound and can form the basis for novel innovation practices. This paper lays out the first step towards a complete methodology of interreligious investigation, emphasizing the issue of how we should treat individual religions while not committing ourselves to religious apologetics in general. From that perspective, I introduce two theoretical requirements that the methodology of interreligious exploration should fulfill, what we call the constraint of consistency and ontology and the constraint of absoluteness and plurality. The article expounds how and on what grounds those two methodological constraints can be fulfilled by (...) the philosophical notions of “naturalism” and “religion as grammar.” In doing so we reach the following methodological canons: When initiating interreligious exploration, (1) adopt an “open-ended minimal naturalism” in which transcendent realities appearing in individual religions are neither affirmed nor denied in advance, and (2) on the basis of that naturalism, take individual religions as different systems of grammar, that is, distinct linguistic-conceptual frameworks upon which one can see and understand various religious worlds in a constitutive way. The negative co‐variation of life‐history traits such as fecundity and lifespan across species suggests the existence of ubiquitous trade‐offs. Mechanistically, trade‐offs result from the need to differentially allocate limited resources to traits like reproduction versus self‐maintenance, with selection favoring the evolution of optimal allocation mechanism. Here I discuss the physiological (endocrine) mechanisms that underlie optimal allocation rules and how such rules evolve. The hormone testosterone may mediate life‐history trade‐offs due to its pleiotropic actions in male vertebrates. Conservation in the actions (...) of testosterone in vertebrates has prompted the ‘evolutionary constraint hypothesis,’ which assumes that testosterone signaling mechanisms and male traits evolve as a unit. This hypothesis implies that the actions of testosterone are similar across sexes and species, and only the levels of circulating testosterone concentrations change during evolution. In contrast, the ‘evolutionary potential hypothesis’ proposes that testosterone signaling mechanisms and male traits evolve independently. In the latter scenario, the linkage between hormone and traits itself can be shaped by selection, leading to variation in trade‐off functions. I will review recent case studies supporting the evolutionary potential hypothesis and suggest micro‐evolutionary experiments to unravel the mechanistic basis of life‐history evolution. We live in an increasingly globalizing world, in which countries are closely linked by international trade and investment ties. Cross-cultural comparative studies of national values and ethics have attracted growing research interest in recent years, because shared practices, values and ethical standards depend on shared beliefs. However, the findings of such studies have been unable to reach a consensus on the impact of culture on ethics-related attitudes and behavior. Empirically, many "cross–cultural" differences reported by previous studies might actually stem from (...) cross-national differences. In order to partially fill this gap, this study advocates an analytical framework that isolates the role of cultural and national differences in order to test their relationship to individual level variables. Within this framework, we test competing hypotheses based on both cultural and national contexts by comparing groups of Chinese and American respondents together with a "bridging group" of Chinese Chinese-Americans. Theoretically, this contextual approach helps resolve the debate on the role of culture, by showing that culture plays a far more important role in shaping value orientations than the national background. Specifically, the two ethnic Chinese groups had many cultural values in common, and differed significantly from the Caucasian group. Implications are discussed. (shrink)

The article examines the status of free speech in Vietnam in light of some of the explosive debates that have flared up in both the US and Europe. It argues that unlike in the West the Vietnamese case requires a critical defense to augment the space for free speech as such. To lead up to this conclusion, the essay looks at two case studies of literary censorship in Vietnam (...) to demonstrate that, since the middle of the twentieth-century, literary speech has been synonymous with political speech. Given the limited space for political speech itself, the essay concludes by advancing a version of the autonomy defense of free speech as one viable critical resource in the Vietnamese context. This article explains the attempts of nurses to practice humanistic, holistic care in line with their professionalizing strategy. Ideally, the intention of nurses is to broaden their concerns beyond the physiological needs of patients, thereby circumventing biomedical control over their work. However, the author argues that resource constraints, and the coalescing of biomedical and managerial definitions of patients, suggest that holistic notions of care are subjected to a new form of calculus and normalizing technology. Critically, nurses are more preoccupied with (...) the day-to-day struggle to free up resources for healthcare, in particular bed spaces, and to pre-empt the problem of bed blocking. Such work suggests that the ‘emptying of beds’ is not just a symbol of accomplishment for nursing work. From the governmentality theory of Foucault, the administration of ‘beds’ has become part of the managerial power/knowledge discourse and an instrument for making nurses toe the financial bottom-line. Computational drug repositioning has been proven as a promising and efficient strategy for discovering new uses from existing drugs. To achieve this goal, a number of computational methods have been proposed, which are based on different data sources of drugs and diseases. These methods approach the problem using either machine learning- or network-based models with an assumption that similar drugs can be used for similar diseases to identify new indications of drugs. Therefore, similarities between drugs and between diseases are usually (...) used as inputs. In addition, known drug-disease associations are also needed for the methods as prior information. It should be noted that those associations are still not well established due to the fact that many of marketed drugs have been withdrawn and this could affect the outcome of the methods. In this study, we propose a novel method named RLSDR to find new uses of drugs. More specifically, it relies on a semi-supervised learning model, Regularized Least Square, thus it does not require definition of non-drug-disease associations as previously proposed machine learning-based methods. In addition, the similarity between drugs measured by chemical structures of drug compounds and the similarity between diseases which share phenotypes can be represented in a form of either similarity network or similarity matrix as inputs of the method. Moreover, instead of using a gold-standard set of known drug-disease associations, we construct an artificial set of the associations based on known disease-gene and drug-target associations. Experiment results demonstrate that RLSDR achieves better prediction performance on the artificial set of drug-disease associations than that on the gold-standard ones in terms of area under the Receiver Operating Characteristic curve. In addition, it outperforms two representative network-based methods irrespective of the prior information of drug-disease associations. Novel indications for a number of drugs are also identified and validated by evidences from a different data resource. (shrink)

The COVID-19 pandemic prompted a nudge for public–private cooperation in healthcare to rapidly cope with limited resource. However, Vietnam’s historical reliance on a public healthcare system, combined with a traditional emphasis on socialization in the Polanyian sense, hindered the swift integration of the private sector. This research investigates path dependency in Vietnam’s public health sector, using theories including path dependency, Karl Polanyi’s double movement with legal analysis method to analyze the interplay of historical decisions, and socialist policies in healthcare. Recognizing (...) these institutional and market governance flaws, a deeper understanding of the role of law becomes vital in crafting strategies for a more resilient and sustainable healthcare system in Vietnam. In this article, Ho Chi Minh City is chosen as a case study due to its notable mix of public–private healthcare facilities and its status as a leading area in infection cases during the third COVID-19 wave. The article suggests that there should be a change in the way public and private sectors work together, one that is more in line with market-driven solutions which requires solid legal framework for cooperation beyond merely mobilizing resources. We present our method for tackling a legal case retrieval task by introducing our method of encoding documents by summarizing them into continuous vector space via our phrase scoring framework utilizing deep neural networks. On the other hand, we explore the benefits from combining lexical features and latent features generated with neural networks. Our experiments show that lexical features and latent features generated with neural networks complement each other to improve the retrieval system performance. Furthermore, our experimental results suggest the (...) importance of case summarization in different aspects: using provided summaries and performing encoded summarization. Our approach achieved F1 of 65.6% and 57.6% on the experimental datasets of legal case retrieval tasks. (shrink)

Building on a previous piece that harnessed both the handbook that Saint Ignatius of Loyola (1548/ 1991 ) authored to guide his work – the _Spiritual Exercises_ – and the account of his own transformation experience captured in the _Autobiography_ – to appropriate the dynamics of Ignatius’ _Spiritual Exercises_ into a series of life-affirming questions and delineate his transformation into four phases (Carey and Tran 2023 ), this essay continues our exploratory inquiry. Following a brief overview of the contemporary organizational (...) leadership context, our article positions Ignatius’ insights on transformation within the transformational leadership discourse and considers his contribution to the professional formation of business leaders. Our study concludes with qualitative examples of how insights from St. Ignatius’ conversion process has encouraged online graduate students of organizational leadership in their quest to transition from profession to purpose. To further fuse theory and practice, the student reflections are categorized according to the Ignatian-inspired questions that inaugurated our theoretical inquiry and guides our pedagogical practice as organizational leadership educators. Cultural diplomacy is a special form of cultural application to improve diplomatic effectiveness, create, and promote national culture. Since the Cold War until now, South Korea, Japan, and India have been continuously promoting cultural diplomacy based on the dissemination of increasingly interconnected literary and cinematic publications. Cultural diplomacy with Vietnam has also helped South Korea, Japan, and India maximize their role as responsible powers for a typical Southeast Asian country, Vietnam. Through three typical cases in promoting the role of cultural (...) diplomacy to preserve Oriental cultural identity: Japan, India, and South Korea, by using systemic and interdisciplinary methods, the article focuses on four main characteristics that demonstrate the role of cultural diplomacy in preserving Oriental cultural identity in these countries, the quantity, content, implementation situation, and economic - political - social role of cultural products are utilized and promoted in cultural diplomacy of South Korea, Japan, and India. The article shows that cultural diplomacy not only spreads Oriental cultural values, contributing to maintaining economic growth of the Asian countries mentioned in the article, but also helps improve national brand image, enhance the position and national potential in the international stage. When The Sound of One Hand Clapping came out in Japan in 1916 it caused a scandal. Zen was a secretive practice, its wisdom relayed from master to novice in strictest privacy. That a handbook existed recording not only the riddling koans that are central to Zen teaching but also detailing the answers to them seemed to mark Zen as rote, not revelatory. For all that, The Sound of One Hand Clapping opens the door to Zen like no other book. (...) Including koans that go back to the master who first brought the koanteaching method from Japan to China in the eighteenth century, this book offers, in the words of the translator, editor, and Zen initiate Yoel Hoffmann, "the clearest, most detailed, and most correct picture of Zen" that can be found. This article addresses two shortcomings in the literature on nationalism: the need to theorize transformations of nationalism, and the relative absence of comparative works on Latin America. We propose a state-focused theoretical framework, centered on conflicts between states elites and social movements, for explaining transformations of nationalism. Different configurations of four key factors — the mobilization of excluded elites and subordinate actors, state elites’ political control, the ideological capacities of states, and polarization around ethnoracial cleavages — shape how contrasting trajectories (...) of nationalism unfold over time. A comparative analysis of early– and mid–twentieth century Mexico, Argentina, and Peru illustrates the explanatory power of our theoretical framework. (shrink)

Using an institutional perspective, this paper investigates how consumers in Western developed and Southeast Asian emerging markets respond to fashion brands’ moral transgressions and how consumers’ moral rationalization tendencies vary across the two markets. The study employs multimethod analyses, including cross-national secondary data from 12 countries and experimental data from 940 German and Vietnamese consumers. In a non-transgression context, the multivariate analyses show that Western developed-market consumers embrace higher ethical standards (Study 1A), tend to seek collective action against prevalent immoral (...) behaviors in society (Study 1B), and are more critical in evaluating fashion brand ethicality than Southeast Asian emerging-market consumers (Study 2). However, in a transgression context, the moderated mediation analyses reveal that consumers largely do not differ in their direct devaluation of fashion brand ethicality and subsequent price considerations (Study 3) across six transgression scenarios (i.e., worker abuse, child labor, racist advertising, weight discrimination, climate change, and environmental pollution). Interestingly, moral rationalization processes appear to be more frequent and consequential in the Southeast Asian emerging market, while they either do not occur or are significantly weaker in the Western developed market. The results provide theoretical and practical implications for ethical business practices in the fashion industry based on market differences in regulatory frameworks, cognitive considerations, and social norms. Les réflexions de Feuerbach sur ces problèmes, principalement dans les Pensées sur la mort et l'immortalité (1830) et La question de l'immortalité du point de vue de l'anthropologie (1846), ont pour but de dissiper les entités imaginaires de l'au-delà et de poser la vérité et la consistance de ce monde. La (...) problématique est hégélienne au départ, mais Feuerbach remanie dans la suite certains concepts-clefs du hégélianisme, comme l'Esprit, l'infini, etc. Le résultat est paradoxal : l'homme, qu'il prétend libérer de la peur de la mort ainsi que du rêve de l'immortalité, se voit entièrement subordonné à la société. This paper investigates the task of reference resolution in the legal domain. This is a new interesting task in Legal Engineering research. The goal is to create a system which can automatically detect references and then extracts their referents. Previous work limits itself to detect and resolve references at the document targets. In this paper, we go a step further in trying to resolve references to sub-document targets. Referents extracted are the smallest fragments of texts in documents, rather than the (...) entire documents that contain the referenced texts. Based on analyzing the characteristics of reference phenomena in legal texts, we propose a four-step framework to deal with the task: mention detection, contextual information extraction, antecedent candidate extraction, and antecedent determination. We also show how machine learning methods can be exploited in each step. The final system achieves 80.06 % in the F1 score for detecting references, 85.61 % accuracy for resolving them, and 67.02 % in the F1 score for the end-to-end setting task on the Japanese National Pension Law corpus. Plagiarism in higher education has become widespread among students in Vietnam. This paper aims to examine the seriousness of the problem by comparing the severity of plagiarism in two universities, one of which uses Turnitin software to check its student reports. For that purpose, 977 samples have been drawn from 1434 required graduation reports written by senior undergraduates in the economics and management field from 2013 to 2015. Turnitin’s “Similarity Index” was used to check for alleged plagiarism, which was found (...) to be more widespread at the university not using Turnitin. At that university, 91.7% of the graduation reports were defined as plagiarized, while 61.7% of the reports were plagiarized at the university using the software. The main source of this problem was the use of information from the internet without citing the original authors. (shrink)

Currently, there is significant debate over whether brain death is an appropriate method of declaring an individual dead. As it would be illicit to cause the death of a patient by removing their organs, a medical professional must be certain that a brain dead patient is, in fact, dead before the procedure.
